If I called a locksmith but I got into my house or car without his help, do I still have to pay him?

Last month the Hollywood actress Lindsay Lohan called a locksmith to get into her girlfriend’s house. However, while the professional was doing his job, trying to get her in, Lindsay founded a way in breaking through the window and then refused to pay the locksmith, even his $39 call-out-fee.

Is a common sense that if you call an emergency service there is a minimum amount the professional should be paid, no matter what happens, for taking his time and coming to see you.
